Expert Witness Testimony
EnviroGroup has supported law firms in both consulting expert and testifying expert roles
on matters related to metals and organic compounds in soil and groundwater, remediation
methods, remediation costs, and vapor intrusion. Some cases have involved claims in the
range of $100 million.
We have particular expertise in the areas of metals contamination of soil, including
background concentrations, sources of metals contamination, and soil remediation. We are
also one of the foremost experts in the area of vapor intrusion investigation and
control for chlorinated compounds, such as PCE, TCE, and DCE.
Forensic Investigations
Our forensic investigation services include identification of sources of contamination,
using state-of-the-art fingerprinting techniques, and evaluation of release time frames
to address insurance coverage and responsible party issues.
Source Identification
In one case, EnviroGroup was able to establish that arsenic concentrations found in soils
on hundred’s of residential properties were due to historic pesticide application and
not emissions from our client’s historic smelter operations. Lines of evidence included
spatial patterns that coincided with property lines, metals ratios consistent with historic
products, product-like particle structures based on electron microscopy, and correlation
of arsenic concentrations with lawns in historic aerial photographs.
Release Timing
In other cases, EnviroGroup has used plume travel time estimates, ratios of degradation
products to parent products for organic compounds, and historic aerial photography to
estimate the most probably time frames for releases, establishing that insurance
coverage should apply.
Cost Recovery
In matters related to remediation costs and damages, EnviroGroup experts have provided
testimony on reasonable costs for soil and groundwater remediation, and mitigation of
vapor intrusion. |
